GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale are those of THE DIFFERENT COMPANY, owner of the website www.lastationtdc.fr .

These general terms and conditions of sale apply to any sale of products made to natural persons (hereinafter referred to as the "Customer") via the website www.lastationtdc.fr or its derived addresses (hereinafter referred to as the "Site").

THE DIFFERENT COMPANY offers the Customer browsing the website the sale of, among other things, perfumery, cosmetics, personal hygiene products and candles (hereinafter referred to as the "Products"). It is specified that the Products are intended exclusively for the Customer's personal use and may not be purchased for resale.

These terms and conditions shall not be intended to, nor shall they have the effect of, depriving customers in the European Union of the mandatory legal provisions provided by the legislation of their own country. If any provision of these terms and conditions is found to be contrary to the mandatory rules of law to which the Customer may be entitled under their national legislation, that provision shall not apply to that Customer, and all other provisions shall remain in full force and effect.

The Client's consultation of the Site is also governed by the Site's terms of use, which he accepts without reservation.

For the purposes of this Agreement, it is agreed that the Client and THE DIFFERENT COMPANY shall be collectively referred to as the “Parties” and individually as a “Party”.

ARTICLE 1: SCOPE OF APPLICATION

These General Terms and Conditions of Sale define the terms of sale of THE DIFFERENT COMPANY Products to the Customer, as well as the rights and obligations of the Parties arising from the sale of the Products offered on the Site www.lastationtdc.fr .

THE DIFFERENT COMPANY may update these General Terms and Conditions of Sale at any time without prior notice, and they may be consulted by the Customer at any time. These General Terms and Conditions of Sale govern without restriction all sales of Products made on THE DIFFERENT COMPANY online store.

By placing an order for a Product on the Site, the Customer acknowledges having read and accepted these General Terms and Conditions of Sale without reservation. As these General Terms and Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer's purchase is the one in effect on the Site on the date the order is placed. This acceptance is in no way conditional upon a handwritten signature from the Customer. It is specified that the Customer may save or print these General Terms and Conditions of Sale, provided, however, that they are not modified.

ARTICLE 2: THE PRODUCTS

2.1 Product Description

THE DIFFERENT COMPANY presents on the Site the Products for sale as well as their detailed descriptions in the product pages.

2.2. Availability

At any time THE DIFFERENT COMPANY reserves the right to modify or discontinue marketing the Products offered on the Site, however these modifications will not affect orders that THE DIFFERENT COMPANY has accepted before the entry into force of these modifications.

Each product page indicates the availability time for order shipment. However, if a product is unexpectedly out of stock, thus delaying order shipment, an email will be sent to the customer.

2.3 Price

2.3.1. All product prices are shown in Euros, including VAT. The applicable prices are those displayed on the Website at the time the Customer places their order, except in the case of typographical errors. Product prices exclude delivery costs, which are added to the order total on the "Shopping Cart" page. Customs duties are not included in product prices or the order total and may be payable upon delivery in accordance with local regulations.

2.3.2. THE DIFFERENT COMPANY reserves the right to modify its prices at any time and without prior notice. However, these modifications will not affect orders that THE DIFFERENT COMPANY has accepted before the effective date of these modifications, subject to the availability of the ordered Products. Product offers are valid as long as they are visible on the website, within the limits of available stock.

2.3.3. For all orders (excluding sample sets), THE DIFFERENT COMPANY may offer a sample of a fragrance of its choice; the customer does not have the option to choose their free sample. THE DIFFERENT COMPANY reserves the right to provide customers with product samples or free products free of charge. However, these offers may be revoked at any time.

ARTICLE 3: ORDER

3.1 Ordering Procedure

By browsing the Site, the Customer has the opportunity to view the Products offered for sale on the day of their visit. Browsing the various pages of the Site does not obligate the Customer to place an order. The choice and purchase of a Product is the sole responsibility of the Customer.

While browsing the Site, a Customer wishing to place an order can do so by simply clicking on the "Add to cart" icon located below the product description. By default, the quantity displayed is 1. If the desired quantity is greater than 1 unit, the Customer can manually adjust the quantity.

The Customer can view their order by clicking on "My Cart" and can add to, modify, or cancel it at any time before the payment stage. On this same page, the Customer can also see an estimate of the delivery costs.

Once the product selection is complete, the Customer can place their order by clicking on "Validate your basket". A new web page will then open, prompting the Customer to log in or create an account. The Customer must provide their contact information by accurately completing the form provided. They will then choose their preferred delivery method.

The Customer must check all information relating to their order before selecting a payment method and accept the General Terms and Conditions of Sale before confirming and proceeding with payment for their order.

The data recorded by THE DIFFERENT COMPANY constitutes proof of all transactions between THE DIFFERENT COMPANY and the Client.

3.2. Order Confirmation

3.2.1. Once these General Terms and Conditions of Sale have been accepted and the cash payment validated, a printable and savable summary of the Customer's order will be displayed and will mention in particular the order references.

The Customer will receive a confirmation email containing all the details of their order placed on the website www.lastationtdc.fr .

3.2.2. THE DIFFERENT COMPANY retains ownership of the product(s) ordered until full payment of the price and its accessories, including shipping costs.

3.2.3. In order to protect THE DIFFERENT COMPANY from abusive, fraudulent, or non-compliant practices with the distribution networks it has put in place, in the event that THE DIFFERENT COMPANY suspects one of these practices during an order, THE DIFFERENT COMPANY reserves the right to request additional documents from the Customer (proof of address and debit in the Customer's name, photocopy of the Customer's identity card, photocopy of the Customer's bank card, or other) in order to dispel the suspicion of such practices.

If the Client does not respond within fifteen (15) days of THE DIFFERENT COMPANY sending the request, the order will be cancelled and THE DIFFERENT COMPANY will proceed as soon as possible to refund it to the bank account debited when the order was placed.

3.3 Proof of Order

In general, it is expressly agreed between THE DIFFERENT COMPANY and the Client that emails will be considered valid between the Parties as well as automatic recording systems on the Site, particularly with regard to the nature of the order.

The Customer may access, where applicable in accordance with general legal principles, the electronic contract concluded between the Customer and THE DIFFERENT COMPANY. To do so, they should contact Customer Service by email at bonjour@lastationtdc.fr , providing all necessary information, including the order number and their contact details.

ARTICLE 4: PAYMENT

4.1. Payment must be made online at the time of ordering, in Euros, by credit card, PayPal, or other payment services available on the website at the time the customer places the order. Orders are processed upon receipt of full payment from the customer, except in cases of non-validation by the bank or financial institution managing the customer's payment method.

4.2. THE DIFFERENT COMPANY reserves the right to refuse any order or delivery in the event of an existing dispute with the Customer, total or partial non-payment of a previous order by the Customer, refusal of payment authorization by bank card from banking institutions or financial intermediaries, non-payment or partial payment.

4.3. The Customer guarantees THE DIFFERENT COMPANY that it has all the necessary authorizations to use the payment method chosen at the time of order confirmation. In the event of a bank refusal, the order will be automatically cancelled.

4.4. THE DIFFERENT COMPANY uses the Stripe payment platform (10 Boulevard Haussmann, 75009 Paris) as well as the PayPal payment platform.

ARTICLE 5: DELIVERY

5.1. Delivery methods

The ordered products will be delivered to the postal address provided by the customer when placing their order online ( My Account section, Your contact details and My delivery addresses ).

All our packages are shipped

  • Either via the Colissimo carrier
  • Either via the carrier Deliver.ee

The customer will be able to track the progress of their delivery on the website www.lastationtdc.fr , under the heading My Account (Your Orders ) by entering their email address and password provided when creating their account and placing their order.

Delivery by Colissimo

If the customer is absent, the Colissimo carrier will leave a delivery notice in the customer's mailbox. The customer must then contact the carrier to arrange a new delivery date. However, if the customer does not contact the carrier, the latter will make two (2) further delivery attempts, the date and time of which will be determined at the carrier's discretion. As delivery is handled by a third-party provider, THE DIFFERENT COMPANY cannot be held liable if the non-performance or improper performance of this obligation is attributable to the customer, to an unforeseeable or insurmountable event caused by a third party to the contract, or to a case of force majeure.

Deliveries by Deliver.ee

The customer has the option of having their order delivered using the Deliver.ee courier services offered on the website www.lastationtdc.fr and under the conditions in force at the time of use of this service.

These conditions include, in particular

  • A limited list of municipalities served
  • A charge for waiting time at the delivery location exceeding 10 minutes to hand the package to the customer (5 Euros per 10-minute increment).
  • Specific delivery charges that the customer must pay before delivery of the package and purchased products.

5.2. Deadlines

The Products will be shipped via the carrier Colissimo, whose average delivery times are given for informational purposes only and are:

  • France: 3 business days from the date of dispatch
  • International: 2 to 10 business days from the date of shipment

Saturdays, Sundays and public holidays in France are not considered working days.

In any event, the order will be executed within a maximum period of thirty (30) days from the day following the day on which the Customer transmitted his order, subject to full payment of the price.

Personalized engraving of a bottle extends delivery times by one (1) to two (2) calendar week(s) (for France and International).

5.3. Delivery charges

Delivery is free within mainland France under the conditions specified on the website at the time of order payment. The delivery price is calculated based on the destination and the weight of the package.

For deliveries to the rest of the world, shipping costs vary depending on the weight of the order and the delivery location. Any additional customs fees are the responsibility of the customer.

5.4. Delivery Delay

If the maximum delivery period of thirty (30) days is exceeded and the ordered product(s) have not yet been shipped, the customer may cancel their order within fourteen (14) days by registered letter with acknowledgment of receipt sent to the following address:

Upon receipt of the customer's letter and if delivery has not occurred in the meantime, THE DIFFERENT COMPANY will refund the total amount of the order placed to the bank account debited at the time of the order, as soon as possible, excluding any other compensation.

In the event of partial delivery, the delivery may be made in several installments, and the customer may only cancel their order for the undelivered balance.

Any delivery delay must be reported by the customer as soon as possible by email to info@thedc.fr so that THE DIFFERENT COMPANY can open an investigation with the carrier. The customer should be aware that the duration of an investigation is unpredictable, as THE DIFFERENT COMPANY has no control over its progress. If the package is located during this investigation, it will be immediately reshipped to the delivery address specified in the customer's order.

However, if at the end of this investigation it is confirmed that the loss of the package containing the product(s) is/are confirmed, THE DIFFERENT COMPANY will, at its own expense, reship the product(s) to the customer or in the event of permanent unavailability, will reimburse the customer, to the bank account debited at the time of the order, for the sums collected in accordance with the terms of these General Terms and Conditions of Sale .

If the customer is unavailable at their delivery address, or if delivery to the address specified during the order process is impossible due to postal services, the package will be made available to the customer at a chosen collection point. If the package is not claimed by the customer within 7 to 15 days (depending on the postal service and the country), it will be automatically returned to the sender, THE DIFFERENT COMPANY. Upon receipt of the package by THE DIFFERENT COMPANY, the customer will be notified, their order will be canceled, and they will receive a full refund within 7 days of the package's return.

5.4. Reception

Each delivery is deemed to have been made upon the product(s) being made available to the customer by the carrier, as evidenced by the control system used by the carrier.

It is the customer's responsibility to check immediately upon receipt of the product(s) the conformity and integrity of the product(s) shipped.

In the event of delay, breakage, or missing items, the customer must note complete and precise reservations on the delivery slip. In any case, the customer may only pursue a claim against the carrier, to whom they must submit their reservations. All reservations must be confirmed by registered letter to the carrier within three (3) days of receipt.

Any such reservation must also be notified to THE DIFFERENT COMPANY's Customer Service within the same timeframe and in the same format at the following address:

A copy of the claim sent to the carrier must be attached. Any claim made after this deadline or not in the required format will be rejected, and THE DIFFERENT COMPANY will be released from all liability.

ARTICLE 6: RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L. 221-18 of the French Consumer Code, the customer has a withdrawal period of fourteen (14) days from the date of receipt of their product(s). In the case of an order including several items delivered in multiple shipments, the fourteen (14) day period will begin upon receipt of the last item.

In this case, the customer must submit their request via the Withdrawal Form on the website www.lastationtdc.fr or by email to info@thedc.fr and must return the complete product(s), in perfect condition and in their original packaging, accompanied by a copy of the return slip, within fourteen (14) days to the following address:

In accordance with the provisions of Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised concerning personal hygiene and cosmetic products for reasons of hygiene and health protection, personalized products or products made according to the customer's specifications (engraved bottles, personalized boxes), nor for products that have been opened and/or damaged and/or unsealed and/or used after delivery.

Furthermore, and to avoid fraud, no returns or refunds will be accepted in this context for products paid for using promotional materials (loyalty account points, lotteries, marketing offers, etc.) or which were subject to a direct or indirect discount at the time of purchase on the website www.lastationtdc.fr.

Similarly, we reserve the right to check the batch numbers of returned products to ensure they were purchased on the website www.lastationtdc.fr. In any case, any returned product not purchased on our website will not be eligible for exchange or a partial or full refund. Furthermore, we reserve the right to file a complaint for attempted fraud if the fraudulent nature of the return and refund request is proven.

Return shipping costs are the responsibility of the customer, except in the case of an error on the part of THE DIFFERENT COMPANY. In the latter case, THE DIFFERENT COMPANY will send the customer a prepaid Colissimo return label or reimburse the return shipping costs.

If the customer cancels their entire order, and this cancellation is valid according to the law and our General Terms and Conditions of Sale, THE DIFFERENT COMPANY is obligated to refund all sums paid, including delivery charges, but excluding return shipping costs, which are the customer's responsibility. THE DIFFERENT COMPANY is not required to refund additional delivery charges when the customer has chosen an express delivery method, which is more expensive than standard Colissimo delivery.

THE DIFFERENT COMPANY undertakes to reimburse the customer using the same initial means of payment, within a maximum period of fourteen (14) days from the date of the withdrawal request, subject to compliance with the conditions mentioned above.

In the event of the return of the product(s) outside the aforementioned period, the customer will not be reimbursed.

ARTICLE 7: PRODUCT CONFORMITY AND WARRANTY

The Product(s) are subject to the conditions and guarantees provided for by French law.

THE DIFFERENT COMPANY, as a professional seller, guarantees that the Products conform to their intended use and do not have any defects or hidden flaws that would make them dangerous or unsuitable for their normal use.

Furthermore, for any non-conforming Product, the Customer must contact THE DIFFERENT COMPANY's Internet Customer Service by mail at 37-39 rue Louise Weiss PARIS France or by email at: info@thedc.fr

Customer Service will then inform the Customer of the procedure to follow.

The Products must be returned in their original packaging and condition with the product return form within fourteen (14) days from the date of receipt of the Product(s) by the Customer.

THE DIFFERENT COMPANY does not accept packages sent with postage due. All risks associated with the return of the product(s) are the responsibility of the customer.

Upon receipt of the product(s) presumed to be non-compliant, THE DIFFERENT COMPANY will carry out an inspection of the product(s) as soon as possible. If the non-compliant nature of the product(s) is confirmed, THE DIFFERENT COMPANY will then proceed with a refund (including the initial delivery charges), to the account debited at the time of the order, for the non-compliant product(s) within fourteen (14) days from the date of the withdrawal request, subject to compliance with the conditions mentioned above.

ARTICLE 8: LIABILITY

THE DIFFERENT COMPANY cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, including service interruptions, external intrusions, or the presence of computer viruses.

Without limiting the scope of the foregoing provisions, THE DIFFERENT COMPANY's liability hereunder shall not exceed an amount equal to the sums paid or payable in the transaction giving rise to such liability, regardless of the cause or form of action concerned.

THE DIFFERENT COMPANY is not responsible for any failure to perform its obligations, as defined herein, resulting from a case of force majeure.

ARTICLE 9: LEGAL NOTICES AND LEGAL CLAUSES

9.1. Force majeure

Neither Party shall be held liable for the total or partial non-performance of its obligations if such non-performance is due to unforeseen circumstances or the occurrence of a force majeure event, including but not limited to flooding, fire, storms, shortages of raw materials, transportation strikes, partial or total strikes, or lockouts. The Party affected by such events shall inform the other Party as soon as possible and no later than five (5) business days after the occurrence of the event. The Parties agree to consult with each other as soon as possible to determine how the order will be fulfilled during the period of force majeure. If the force majeure event lasts for more than one (1) month, THE DIFFERENT COMPANY may cancel the order, in which case THE DIFFERENT COMPANY shall reimburse the Client for any sums paid for the order in question.

9.2. Partial non-validation

If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law, regulation or as a result of a final decision of a competent court, the other provisions shall remain in full force and effect.

9.3. Amendments to the general terms and conditions of sale

THE DIFFERENT COMPANY reserves the right to modify these terms and conditions of sale. Any new version will be posted on the Website. The online version on the Website will prevail, where applicable, over any other version of these terms and conditions of sale.

9.4. Entire Agreement

These general terms and conditions of sale and the order summary sent to the Customer form a contractual whole and constitute the entirety of the contractual relations between the Parties.

9.5. Cookies

THE DIFFERENT COMPANY may place a cookie on the Client's computer during browsing of the Site. This cookie allows THE DIFFERENT COMPANY to record information relating to the Client's computer's browsing activity on the Site (pages viewed, date and time of visit, etc.) and also aims to improve the browsing and user experience of the Site, particularly through the personalization of certain pages. The Client can prevent the storage of cookies by configuring their browser accordingly.

9.6. Applicable Law - Disputes

The law applicable to these general terms and conditions of sale and to the sales relating thereto is French law.

Any dispute that may arise in connection with their validity, interpretation or execution and that has not been settled amicably by the Parties shall be submitted to the courts of the jurisdiction of Paris or to the courts whose jurisdiction shall be determined by application of Common Law.

ARTICLE 10: INTELLECTUAL PROPERTY

The website www.lastationtdc.fr is protected by copyright. Use of all or part of the website, including by downloading, reproduction, transmission or display on any medium and by any means, for purposes other than personal and private use for non-commercial purposes is strictly prohibited.

The company names, trademarks, and distinctive signs reproduced on the website www.lastationtdc.fr are also protected under trademark law. The reproduction or representation of all or part of any of the aforementioned signs requires the prior written authorization of THE DIFFERENT COMPANY.

In general, any unauthorized reproduction or representation of trademarks, logos, designs, models, literary, musical, audiovisual, photographic works and more generally of any element likely to be protected by intellectual property rights accessible on THE DIFFERENT COMPANY website (www.lastationtdc.fr) is prohibited and would constitute an infringement within the meaning of Articles L335-2 et seq. of the Intellectual Property Code, unless such reproduction or representation is exclusively reserved for strictly personal and private use.

ARTICLE 11: PERSONAL DATA

Providing the personal information collected during the distance selling process is mandatory, as this information is necessary for processing and delivering orders and for issuing invoices.

This information is strictly confidential and will only be used by THE DIFFERENT COMPANY or its subcontractors, who are subject to the same obligations, for processing orders. Failure to provide this information will result in the automatic rejection of the order.

In accordance with Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms, the Client has a right to access, modify, rectify and delete personal information collected by THE DIFFERENT COMPANY concerning him/her.

THE DIFFERENT COMPANY undertakes not to resell the Client's contact details to third-party companies without their prior consent.
